These Terms & Conditions apply to services provided by xVisual, a trading name of Lethubs Properties Ltd, registered in England and Wales under company number 16547405, with its registered office at 128 City Road, London, England, EC1V 2NX.
By booking, purchasing or using our services, you agree to these Terms & Conditions.
1. About xVisual
xVisual provides professional property photography and property media services to estate agents, landlords, property developers, homeowners and other property professionals.
Our services may include property photography, floor plans, property video tours, drone photography, drone video, Matterport 3D virtual tours, Vieweet 360 virtual tours, virtual staging, image editing and other related property marketing services.
The services included in your booking will be confirmed at the time of booking, quotation or order.
2. Bookings
Bookings may be made through our website, client portal, email, telephone or another agreed method.
The client is responsible for providing accurate information, including the property address, contact details, access arrangements, services required, appointment details and any important property information or special instructions.
A booking is considered confirmed once it has been accepted by xVisual.
3. Property Access
The client is responsible for ensuring that xVisual has permission to enter and photograph the property.
The property must be accessible at the agreed appointment time.
Where applicable, the client must arrange keys, access codes, parking permits, concierge access or access through the property owner, tenant or agent.
If we cannot access the property at the agreed time, an additional visit or cancellation charge may apply.
4. Property Preparation
The property should be ready for photography before our photographer arrives.
Clients should ensure that rooms are clean, tidy and appropriately presented.
Our photographers may make minor adjustments where practical but are not responsible for cleaning, moving heavy furniture, extensive property staging, removing personal belongings, gardening or property maintenance.
Clients should remove confidential documents, valuables, personal photographs or anything they do not want included in photographs or video before the appointment.
5. Photography
We aim to produce professional interior and exterior property photography suitable for property marketing.
The number of final photographs may vary depending on the size, layout, condition and features of the property.
Photography and editing will be completed in accordance with xVisual's normal professional style.
6. Image Editing
Standard professional editing is included where specified as part of the booked service.
This may include adjustments to exposure, colour, contrast, perspective and general presentation.
Advanced editing, object removal, virtual staging or significant alterations may incur an additional charge unless included in the original booking.
7. Floor Plans
Floor plans supplied by xVisual are produced for property marketing and illustrative purposes only.
All measurements are approximate.
Floor plans must not be relied upon for construction, building work, architectural planning, surveying, valuation, legal purposes or furniture fitting where exact measurements are required.
Clients, prospective buyers and tenants should independently verify any measurements that are important to them.
8. Property Video Tours
Property video tours are created for property marketing and promotional purposes.
The style, number of clips and final video length may vary depending on the property and service booked.
Music, transitions, editing and presentation will be selected by xVisual unless otherwise agreed before production.
9. Drone Photography and Video
Drone services are subject to weather conditions, airspace restrictions, property location, local restrictions, safety considerations, suitable take-off and landing areas and applicable aviation requirements.
The drone operator has final responsibility for deciding whether a flight can be safely and lawfully completed.
If drone services cannot be completed due to circumstances outside our reasonable control, we may reschedule the drone element or agree an alternative arrangement.
10. Matterport and 360 Virtual Tours
Matterport, Vieweet and other virtual-tour services may rely on third-party platforms.
Hosting, availability and functionality may therefore depend on those third-party services.
Where a particular hosting period is included in a package, this will be stated in the service description, booking or quotation.
Additional hosting charges may apply where continued hosting is requested beyond the included period.
11. Delivery
Completed media may be delivered through the xVisual client portal, secure download links, cloud storage, email or another agreed delivery method.
We aim to deliver work within the estimated turnaround time shown when booking.
Delivery times are estimates and may occasionally be affected by workload, technical problems, weather, third-party services or circumstances outside our reasonable control.
12. Revisions
If we have made an error in the delivered work, please contact us as soon as reasonably possible.
We will review reasonable correction requests.
Requests involving changes outside the original booking, additional editing, new design requirements or changes based purely on personal preference may be subject to an additional charge.
13. Prices and Payment
All prices are shown in pounds sterling.
VAT will be added where applicable.
Payment terms will be displayed on your booking, quotation or invoice.
The client is responsible for paying all amounts due for completed services.
xVisual may withhold final files, downloads or access to completed media until outstanding invoices have been paid.
14. Cancellation and Rescheduling
If you need to cancel or reschedule an appointment, please contact us as early as possible.
We reserve the right to apply a reasonable fee where a booking is cancelled at short notice, where a photographer has already travelled to the property or where we are unable to access the property at the agreed time.
Where weather or safety conditions prevent a drone service from being completed, we will aim to reschedule the affected service.
Nothing in these Terms & Conditions affects any statutory rights you may have under applicable law.
15. Copyright and Usage
Unless otherwise agreed in writing, copyright in photographs, videos, floor plans and other original media created by xVisual remains with Lethubs Properties Ltd trading as xVisual.
Once payment has been received, the client receives permission to use the delivered media for the marketing and promotion of the property for which the content was commissioned.
The content must not be resold, transferred or licensed to another party for an unrelated commercial purpose without our permission.
16. Portfolio and Marketing Use
Unless confidentiality has been agreed in advance, xVisual may use selected photographs, videos or other media created by us on our website, portfolio, social media, advertising or other promotional material.
If you require a property or project to remain confidential, please tell us before the appointment or before the media is published.
17. Client Responsibilities
The client confirms that they have authority to commission the requested services at the property.
The client is responsible for ensuring that their use of the final media complies with applicable property marketing, advertising and legal requirements.
18. Third-Party Services
Some xVisual services may rely on third-party technology and platforms.
We are not responsible for temporary outages, changes or failures caused by third-party services that are outside our reasonable control.
19. Limitation of Liability
xVisual will provide its services with reasonable care and skill.
We are not responsible for losses resulting from incorrect information supplied by the client, failure to provide property access, circumstances outside our reasonable control, third-party platform failures or use of our media for purposes other than those for which it was supplied.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
20. Complaints
If you are unhappy with any aspect of our service, please contact us so that we have an opportunity to investigate and resolve the matter.

21. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal requirements.
The latest version will be published on our website.
22. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Nothing in these Terms & Conditions affects any statutory rights available to consumers.
